Yes they can file DUI charges after the fact, but they still need to be able to prove it at trial. Witness testimony and other evidence can be presented at trial but without the blood/breath or urine it will be a much harder case for the DA to prove. Get a good DUI attorney who regularly practices in that courthouse.
